Legal Risk Summary: Layer 1B Engager Capture
Distilled from three independent deep research reports commissioned April 2, 2026: Claude DR (12pp), Gemini DR (16pp), OpenAI DR (17pp). All three reach the same conclusion.
Verdict
Layer 1B (engager identity capture from competitor LinkedIn pages) is legally untenable. The white space exists not because nobody wants this intelligence, but because LinkedIn legally defends the data and punishes commercial scraping.
Evidence
| Company | What Happened | When |
|---|---|---|
| Proxycurl | LinkedIn sued; court-ordered permanent injunction; $10M ARR business destroyed | Jan 2025 |
| KASPR | CNIL fined EUR 240K for scraping; deleted entire 160M-record database | Dec 2024 |
| Common Room | Built competitor engagement capture; removed feature within months | Dec 2024 |
| hiQ | Won CFAA argument but lost on contract law; agreed to cease, destroy data, pay $500K | Dec 2023 |
| ProAPIs | Sued by LinkedIn for creating fake accounts | Oct 2025 |
The API Wall
- LinkedIn Marketing Developer Platform: aggregate stats only
- Reactions API: individual URNs only for admins/sponsors of YOUR OWN content
- No official API access to competitor page engagement data at individual level
- This is absolute. There is no workaround through official channels.
Key Variable: Amplemarket
Amplemarket is commercially operating contact-level competitor engagement intelligence. If they operate without enforcement, it signals either: - LinkedIn tolerates some scraping at lower scale, OR - Amplemarket has a defensible method or partnership
Action: Investigate Amplemarket's methodology, legal posture, and LinkedIn relationship before committing to any Layer 1B architecture.
Three Defensible Paths
-
Own-page engagement analytics -- LinkedIn Reactions API (authorized). Analyze your own page engagers. Segment by role, seniority, industry. Legal risk: ZERO.
-
Public signals CI -- Analyze competitor post CONTENT (public), job postings, website changes, G2 reviews, press. Layer AI narrative analysis. Legal risk: LOW.
-
Multi-signal intent layer -- Partner with intent data vendors (Bombora, 6sense). Client provides their own LinkedIn data. Layer narrative intelligence. Legal risk: MEDIUM.
Impact on LENS v1
v1 operates on Layer 1A only (safe). Implications for Explore: - Content Gap: Fully viable (public content analysis) - Narrative Gap: Fully viable (public content analysis) - Cohort Gap: Partially viable (own-page cohorts only) - Switcher Signal: BLOCKED (requires cross-entity engager identity)
